By signing below, I, (the “Guest”), hereby acknowledge, understand, and voluntarily agree to the following terms and conditions applicable to my stay at Wyndham Garden Wailoaloa Beach Fiji (the “Hotel”):

1. Accuracy of Information
I confirm that all personal details and information I have provided to the Hotel are complete, accurate, and truthful.

2. Assumption of Risk
I understand that participation in any on site or off site activity, including but not limited to swimming, sports, excursions, recreational use of Hotel facilities, equipment usage, or travel arranged through or outside the Hotel (collectively, “Activities”), involves inherent risks of injury, illness, property loss, or death.
I voluntarily assume all such risks, whether known or unknown, foreseeable or unforeseeable.

3. Release of Liability
To the fullest extent permitted by law, I release, discharge, and hold harmless Wyndham Garden Wailoaloa Beach Fiji, its owners, officers, employees, agents, affiliates, contractors, and representatives (collectively, the “Released Parties”) from any and all claims, demands, actions, damages, losses, or liability arising out of or related to my participation in any Activities or my presence on Hotel premises, whether caused by negligence or otherwise.

4. Indemnification
I agree to indemnify, defend, and hold harmless the Released Parties from any claims, damages, losses, or expenses (including legal fees) resulting from my actions, negligence, conduct, or participation in Activities.

5. Medical Treatment
I consent to receive emergency medical treatment if required. I accept full financial responsibility for all medical expenses incurred and acknowledge that medical services may be limited or located off site.

6. Compliance with Hotel Policies
I agree to comply with all Hotel rules, policies, safety guidelines, and instructions issued by management or staff. I understand that the Hotel reserves the right to deny service or remove any guest for misconduct, safety concerns, or violation of Hotel policies.

7. Insurance
I acknowledge that the Hotel does not provide personal accident, health, or property insurance. I am solely responsible for obtaining any insurance coverage I deem necessary.

8. Parking Liability
The Hotel provides access to both public and private parking areas. I assume full responsibility for my vehicle(s) and personal belongings left in these areas and release the Hotel from liability for any theft, loss, or damage.

9. Personal Property
I acknowledge that the Hotel is not responsible for loss, theft, or damage to personal belongings located anywhere on Hotel premises, including guest rooms, in room safes, storage areas, or public spaces.

10. Third Party Services
I understand that any tours, transportation, excursions, spa services, or other activities operated by third parties—whether booked through the Hotel or independently—are undertaken at my own risk. The Hotel bears no liability for any injury, loss, or damages arising from third party services.

11. Weather & Force Majeure
I accept all risks associated with weather conditions, natural disasters, and any other force majeure events beyond the Hotel’s control. I release the Hotel from liability for any resulting injury, delay, loss, or property damage.

12. Media Release
I consent to the Hotel capturing photographs or video recordings of general Hotel activities for marketing or promotional use. I waive any right to compensation for such use.

13. Minors
If I am signing on behalf of a minor, I confirm that I am legally authorized to do so and accept full responsibility for the minor. This waiver applies equally to the minor.

14. Governing Law
This Agreement is binding upon me, my heirs, executors, administrators, and assigns, and is governed by the laws of the Republic of Fiji.

Safekeeping of Valuables – Liability Clause
The Hotel provides reasonable security measures for guests’ belongings, including an in room safe and secure storage facilities at the Front Office for valuable items.
Guests are solely responsible for ensuring valuables such as cash, jewelry, documents, electronics, and other personal items are properly secured using the facilities provided.
The Hotel shall not be liable for loss, theft, or damage to items that:
• are left unsecured,
• are not placed inside the in room safe, or
• are not deposited with the Front Office for safekeeping.
By signing this Agreement, the Guest acknowledges that security facilities have been made available and accepts full responsibility for the safekeeping of all personal belongings.
